1. Our role
Simply Smarter provides an independent renewable-energy design, education, comparison and installer-introduction service. We may help you understand your energy requirements, prepare an indicative system design, compare potential solutions and obtain quotations from installers within our partner network.
Unless we expressly agree otherwise in writing, Simply Smarter is not the installer, electrical contractor, MCS contractor, equipment supplier, principal contractor or employer of an installer. We do not carry out the physical installation and do not control an installer's employees, subcontractors, site practices or workmanship.
2. Your contract with the installer
If you decide to proceed with an installer introduced through Simply Smarter, the contract for equipment supply, final design, installation, commissioning, certification, payment, warranties, aftercare and any remedial work is made directly between you and the installer you select.
Before accepting an installer's quotation, you should review its final specification, price, payment schedule, terms and conditions, cancellation rights, insurance, warranties and proposed timescale. Any installation payments should be made in accordance with your agreement with that installer.
3. Installer due diligence
We carry out due diligence on prospective installation partners. Checks may include, where relevant and reasonably available to us, company status, identity and trading information, certifications and accreditations, insurance, trading history, customer reviews, installation experience, financial or business information and other evidence relevant to partner suitability.
Our due diligence is intended to reduce risk and help customers make an informed decision. It is not a guarantee, warranty or representation that an installer will perform every contract satisfactorily, remain solvent, retain every accreditation or continue to meet the same standards in the future. Information can also change after our checks have been completed.
4. Responsibility for the installation
The installer you appoint is responsible for the final physical site survey and for verifying that the proposed system is suitable for your property. The installer is responsible for the final technical and electrical design, structural and roof considerations, equipment compatibility, installation method, workmanship, health and safety, commissioning, certification, building-regulation requirements, DNO applications or restrictions, MCS documentation where applicable, manufacturer requirements and any other obligations forming part of its installation contract.
The installer is also responsible for defects, damage caused by its work, warranty claims, remedial work and post-installation support to the extent required by its contract and applicable law.
5. Simply Smarter designs and recommendations
Any design, specification, generation estimate, battery model, savings calculation, payback illustration or recommendation prepared by Simply Smarter is provided to help you make an informed purchasing decision. It may use information supplied by you together with photographs, mapping, energy-consumption information, tariff information, manufacturer data and other available sources.
All preliminary or indicative designs remain subject to a physical site survey and final verification by the installer before installation. The installer must satisfy itself that the final system is safe, compliant and appropriate for the property.
Energy generation, savings, export income, battery utilisation, tariff benefits and payback periods are estimates and are not guaranteed. Actual results can vary because of weather, shading, orientation, household behaviour, electricity tariffs, export arrangements, equipment performance, grid constraints, system settings and other factors outside our control.
6. Quotations and comparison information
Installer quotations and installer-specific information displayed or supplied through Simply Smarter are provided by, or derived from information concerning, independent installers. We aim to present information clearly and consistently so that customers can compare value rather than price alone.
The installer remains responsible for the accuracy, completeness and validity of its final quotation and specification. You should ensure that the final contract records the equipment, scope of work, exclusions, warranties, timescale and total price you have agreed before placing an order.
7. Changes after a quotation or design
A physical survey or detailed technical assessment may identify circumstances that were not visible during the initial Simply Smarter design process. The installer may therefore recommend reasonable technical changes. Any material change to equipment, system size, price or installation scope should be explained to you and agreed between you and the installer before the affected work proceeds.
8. Problems, complaints and disputes with an installer
Concerns about installation quality, delays, damage, equipment, payment, certification, warranties or other obligations under the installation contract should first be raised directly with the installer.
Simply Smarter may choose to help facilitate communication or review concerns about a partner. Any assistance we provide does not make us a party to the installation contract or transfer the installer's contractual responsibilities to us. Serious or repeated concerns may lead to review, suspension or removal of an installer from our partner network.
9. Limitation of Simply Smarter's responsibility
To the fullest extent permitted by law, Simply Smarter is not responsible for loss, damage, defects, delays, additional costs or other consequences arising from the acts, omissions, workmanship, insolvency, breach of contract or other conduct of an independent installer selected by the customer.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so. Nothing in these Terms is intended to exclude or restrict rights or remedies that cannot lawfully be excluded or restricted under applicable UK consumer law.
10. Customer information and responsibilities
You should provide accurate and complete information relevant to the design and comparison process, including information about the property, electricity consumption and any known constraints. You should tell the installer about relevant changes or circumstances before work begins.
You are responsible for reading the installer's final contract and deciding whether the proposed installer, equipment, price and contractual terms are acceptable to you.
11. Fees and the Simply Smarter Guarantee
The Simply Smarter design, education and comparison service has a one-off fee of £99 + VAT unless a different price is expressly shown to you before purchase. There is no recurring Simply Smarter subscription charge. Installer charges are separate and are governed by your contract with the installer.
The £99 + VAT Simply Smarter service fee is fully refundable if you go on to purchase your system through an eligible participating trusted supplier introduced through the Simply Smarter service. The £99 + VAT service fee is also fully refundable if you are not 100% satisfied with the Simply Smarter service you received. To request a satisfaction refund, contact Simply Smarter and identify the service concerned. This guarantee applies to the Simply Smarter service fee only and does not refund, replace or alter any payment, contract, cancellation right, warranty or remedy relating to an independent installer or supplier. Nothing in this guarantee affects your statutory consumer rights.
12. Intellectual property
Design documents, comparison layouts, reports, website content and other materials created by Simply Smarter remain our intellectual property or that of our licensors unless stated otherwise. You may use materials supplied to you for evaluating and progressing your own renewable-energy project, but you may not commercially reproduce or resell them without permission.
13. Privacy and communications
We process personal information in accordance with our Privacy Policy. To provide the comparison and introduction service, relevant project and contact information may need to be shared with installers you ask us to approach or with service providers supporting the customer journey. Marketing communications will be handled in accordance with applicable law and the choices available to you.
14. Availability and changes to the service
We may update, improve, suspend or change parts of the Simply Smarter service. We may also change the installers participating in our network. We do not guarantee that a particular number of installers will quote for every project or that every technology, location or project will be suitable for our partner network.
15. Statutory rights
Nothing in these Terms affects statutory rights you may have as a consumer. Your rights in relation to an installation are also governed by the contract you enter into with the installer and applicable law.
16. Governing law
These Terms are governed by the law applicable to the relevant contract and consumer. Where mandatory consumer rules give you rights to bring proceedings in another part of the United Kingdom, those rights are not affected by this clause.
17. Acceptance
By creating a Simply Smarter account, using a paid Simply Smarter service, requesting installer quotations or progressing through our comparison service, you agree to these Terms to the extent presented to you as part of that transaction.
Installer-selection acknowledgement
I understand that my installation contract is directly with the installer I select. Simply Smarter Solar&Renewables Ltd. carries out partner due diligence and provides design, comparison and introduction services, but does not carry out or control the installation and is not responsible for the installer's workmanship, contractual performance or warranty obligations, subject always to my statutory rights.
